The establishment, performance, interpretation, and resolution of disputes under this agreement shall be governed by the laws of the People's Republic of China, excluding any other conflict of laws principles. If any dispute arises concerning the content or execution of this agreement, both parties shall resolve it through friendly negotiations; if negotiations fail, both parties agree to submit the dispute to the court located where HYPERGAME TECHNOLOGY LIMITED is domiciled.
1. Service Content1.1 The "EasyLink" platform is a platform that provides online technical services through cloud service technology. It does not directly provide any operational services inside the cloud computers and does not modify or edit any content transmitted by users. The operational services of cloud computers on the "EasyLink" platform are provided by the corresponding third-party service providers of the specific cloud computers. When experiencing cloud computers, users will be bound by the relevant agreements and rules of the third-party service providers (including but not limited to the user's actions such as logging in, recharging, and purchasing virtual items within the cloud computer).
1.2 If a user's use of "EasyLink" platform services does not comply with this agreement, "EasyLink" has the right to make an independent judgment upon discovery through channels such as notifications or reports, and has the right to immediately terminate providing part or all of the services to the user without prior notice. If a user disseminates and spreads reactionary, pornographic, or other information that violates national laws and regulations through "EasyLink" platform services, the system records of the "EasyLink" platform services may serve as evidence of the user's violation of laws and regulations; for any claims from third parties or any damages or losses arising from the user uploading or disseminating such content on the "EasyLink" platform services, the user shall bear full responsibility. If this causes "EasyLink" to suffer losses or penalties, "EasyLink" has the right to claim compensation from the user.
1.3 Based on the user's usage of the "EasyLink" platform, "EasyLink" will continuously improve the product experience, for example, by providing personalized services or enhancing the security of the user's use of the service. Simultaneously, if it is discovered through channels such as notifications or reports that a user violates any provisions of this agreement while using the network services provided by the "EasyLink" platform service, "EasyLink" has the right to require the user to correct the behavior or directly take all measures "EasyLink" deems necessary (including but not limited to suspending or terminating the user's use of the platform services, and/or publicizing the violation of laws or the agreement regarding the use of "EasyLink" platform services user account) to mitigate the impact of the user's improper behavior.
1.4 If the content transmitted by a user allows other users to view or otherwise access or disseminate it, the user must ensure that the publication of the content and the implementation of related actions comply with relevant intellectual property laws and regulations. You acknowledge and agree that "EasyLink" will process qualified infringement notices from third parties in accordance with relevant laws and regulations, delete or prohibit access to the allegedly infringing content as required, and implement appropriate policies to prevent repeated infringement under corresponding circumstances.
2. EasyLink Account Registration Rules2.1 EasyLink account registration information includes but is not limited to the user's EasyLink account name, avatar, password, all information entered when registering or updating the EasyLink account, and all information such as name and avatar entered when the user uses various individual services of EasyLink.
2.2 Users must not include the following illegal and harmful information in the registration information:
(1) Violations of the constitution or laws and regulations;
(2) Endangering national security, leaking state secrets, subverting state power, undermining national unity;
(3) Damaging national honor and interests, harming the public interest;
(4) Inciting ethnic hatred or discrimination, undermining ethnic unity;
(5) Undermining national religious policies, promoting cults and feudal superstitions;
(6) Spreading rumors, disrupting social order, undermining social stability;
(7) Spreading obscenity, pornography, gambling, violence, murder, terror, or inciting crime;
(8) Insulting or defaming others, infringing upon the lawful rights and interests of others;
(9) Containing other content prohibited by laws and administrative regulations.
If the account registration information provided by the user to "EasyLink" is inaccurate, untruthful, or contains illegal or harmful information, "EasyLink" has the right to refuse registration and reserves the right to terminate the user's use of "EasyLink" services. If a user fraudulently registers an account using false information, or if registration information such as account avatar or personal profile contains illegal or harmful information, "EasyLink" has the right to take measures such as ordering corrections within a time limit, suspending use, or canceling registration. For those who impersonate related institutions or social celebrities to register account names, "EasyLink" has the right to cancel the account and report it to the relevant government authorities.
According to relevant laws and regulations and considering the importance of "EasyLink" services, the user agrees:
To proactively submit valid personal identification information for real-name authentication;
To provide timely, detailed, and accurate account registration information (name, mobile phone number, etc.);
To continuously update registration information to meet the requirements of timeliness, detail, and accuracy, except that the identification information provided when registering the "EasyLink" account cannot be updated.
The user agrees that the true, accurate, and legal "EasyLink" account registration information provided serves as the sole evidence for identifying the association between the user and their "EasyLink" account and the user's identity. While enjoying the various services provided by "EasyLink", the user agrees to receive various information services provided by "EasyLink". "EasyLink" reminds users that the identification number filled in when registering a "EasyLink" account or updating registration information cannot be modified after successful "EasyLink" account registration or supplementary filling. Please fill in all registration information carefully.
2.3 All data generated from the user's use of the "EasyLink" account, including but not limited to login records, customer service records, chat records, and social network content created by the user while using "EasyLink", belongs to the "EasyLink" operating company. In case of a dispute, the user agrees that the system data of "EasyLink" shall prevail.
2.4 Users shall not transfer or lend their account and password to others for use. If the account and password are illegally stolen, used, or suffer losses by others due to hacking activities or the user's negligent safekeeping, "EasyLink" assumes no responsibility; if this causes damage to "EasyLink", the user shall compensate for it.
2.5 If a user's "EasyLink" account has not been logged in for 180 consecutive days from the day after the last login, "EasyLink" has the right to take cleaning measures including but not limited to canceling, reclaiming, replacing, or deleting any records of the user's account in the "EasyLink" platform database (including but not limited to registration information, platform payment information, etc.), and the corresponding services provided by "EasyLink" will be terminated simultaneously. 30 days before cleaning up such accounts (the "Notice Period"), "EasyLink" will notify the user through means including but not limited to pop-ups, website announcements, in-site messages, client push notifications, etc. If the user, upon receiving the notice, fails to reactivate the account in a manner recognized by "EasyLink" within the notice period, it will be deemed as automatically waiving the rights to claim, recover, or seek compensation regarding the account and the information contained within the account.
2.6 "EasyLink" solemnly reminds users that if any one or more of the following situations occur, they will bear the consequences, including having all or part of their permissions revoked, or having their account suspended or deleted. If the circumstances are serious, they will also bear corresponding legal responsibility.
1. Using inappropriate or improper ID and nickname;
2. Posting illegal or infringing remarks such as obscene, pornographic, personal attacks, and anti-government speech;
3. Engaging in illegal commercial activities;
4. Imitating administrator IDs or other people's IDs to impersonate administrators or damage the administrator's image;
5. Using illegal software to attack or post improperly;
6. Infringing on others' intellectual property rights or other legitimate rights and interests;
7. Other situations deemed inappropriate by "EasyLink".
3. Platform Service Rules and User Code of Conduct3.1 Recharge Service
3.1.1 "Virtual Currency" can only be used on the "EasyLink" platform to purchase platform technical service products and cannot be exchanged.
3.1.2 Users may only recharge "Virtual Currency", purchase "EasyLink" platform technical service products, or conduct other transactions recognized by "EasyLink" within the "EasyLink" platform or through other methods recognized by "EasyLink". For users who recharge or conduct other related transactions on any recharge platform or other transaction platform not pre-approved by "EasyLink" (including but not limited to situations where users recharge through third parties), "EasyLink" will strictly crack down and impose penalties. Upon verification, "EasyLink" has the right to take various handling measures according to the specific circumstances, including but not limited to one or more of the following: warning, freezing "Virtual Currency", forced offline, freezing account, suspending account, deleting data, and taking other technical measures to prevent users from engaging in such activities; if the circumstances are serious, "EasyLink" reserves the right to pursue the user's legal responsibility.
3.2 Users must not use the services of this software to produce, copy, publish, disseminate, or store information containing the following obscene and pornographic content, including but not limited to:
3.2.1 Disseminating obscene and pornographic content, including but not limited to soliciting prostitution, seeking one-night stands, sexual partners, suggestive chatting, and sleeping together via voice calls;
3.2.2 Pornographic borderline content or sexually suggestive information intended to attract users;
3.2.3 Erotic voice, text, video, or comic content for pornographic purposes, but not limited to the above forms.
If the user violates this clause, "EasyLink" has the right, based on the specific circumstances of the user's violation, to impose penalties on the violating user including but not limited to freezing the account, permanently banning the account, banning the device, deducting service products, and deducting "Virtual Currency".
3.3 Users must not use the services of this software to produce, copy, publish, disseminate, or store information containing the following violent gambling content, including but not limited to:
3.3.1 Disseminating real content depicting the killing or mutilation of humans or animals, as well as injuries such as shootings, stabbings, beatings, etc.;
3.3.2 Content depicting violence, self-harm, etc.;
3.3.3 Involving depictions of disturbing bloody scenes;
3.3.4 Content describing real weapons with the aim of encouraging illegal or reckless use;
3.3.5 Sending content that organizes group gambling, sells gambling devices, teaches gambling techniques (cheating), methods, etc.;
3.3.6 Promoting bloody violence that violates human morality.
If the user violates this clause, "EasyLink" has the right, based on the specific circumstances of the user's violation, to impose penalties on the violating user including but not limited to the following: if it is the user's first violation of the above provisions, "EasyLink" will impose a penalty of freezing the account for 24 hours; if the user violates the above provisions for the second time, "EasyLink" will impose a penalty of freezing the account for 3 days; if the user violates the above provisions for the third time, "EasyLink" will impose a penalty of freezing the account for 15 days; if the user violates the above provisions for the fourth time, "EasyLink" will impose a penalty of permanently freezing the account. If "EasyLink" determines that the user's violation is serious, "EasyLink" has the right to directly impose a penalty of permanently freezing the account or banning the device upon the user's first violation of the above provisions.
3.4 Without authorization from "EasyLink", users must not use the services of this software to produce, copy, publish, disseminate, or store information containing the following advertising and promotional content, including but not limited to:
3.4.1 Promoting other platforms, products, stores, comments, and images;
3.4.2 Directing to other platforms, suspected of fraudulent or illegal profit-making advertising activities;
3.4.3 Sending content promoting products explicitly prohibited by the state or sold without state administrative permits;
3.4.4 Sending content organizing or promoting online part-time jobs;
3.4.5 Maliciously defaming the "EasyLink" platform, maliciously disrupting platform rules, etc.
If the user violates this clause, "EasyLink" has the right, based on the specific circumstances of the user's violation, to impose penalties on the violating user including but not limited to the following: if it is the user's first violation of the above provisions, "EasyLink" will impose a penalty of freezing the account for 24 hours; if the user violates the above provisions for the second time, "EasyLink" will impose a penalty of freezing the account for 3 days; if the user violates the above provisions for the third time, "EasyLink" will impose a penalty of freezing the account for 15 days; if the user violates the above provisions for the fourth time, "EasyLink" will impose a penalty of permanently freezing the account. If "EasyLink" determines that the user's violation is serious, "EasyLink" has the right to directly impose a penalty of permanently freezing the account or banning the device upon the user's first violation of the above provisions.
3.5 Users must not use the services of this software to produce, copy, publish, disseminate, or store information containing the following content that violates internet ethics, including but not limited to:
3.5.1 Maliciously harassing users, especially female users;
3.5.2 Using foul language, insulting others, defaming others, engaging in personal attacks;
3.5.3 Maliciously spamming, screen flooding, maliciously repeating comments, posting content or opinions that clearly do not match the community atmosphere;
3.5.4 Involving the disclosure of others' private information, infringing upon their legitimate rights and interests;
3.5.5 Publishing content that clearly does not conform to the norms;
3.5.6 Other actions infringing upon the legitimate rights and interests of others. If the user violates this clause, "EasyLink" has the right, based on the specific circumstances of the user's violation, to impose penalties on the violating user including but not limited to the following: if it is the user's first violation of the above provisions, "EasyLink" will impose a penalty of freezing the account for 24 hours; if the user violates the above provisions for the second time, "EasyLink" will impose a penalty of freezing the account for 3 days; if the user violates the above provisions for the third time, "EasyLink" will impose a penalty of freezing the account for 15 days; if the user violates the above provisions for the fourth time, "EasyLink" will impose a penalty of permanently freezing the account. If the user's violation is serious, "EasyLink" has the right to directly impose a penalty of permanently freezing the account or banning the device upon the user's first violation of the above provisions.
3.6 The user understands and agrees that "EasyLink" provides relevant services to allow users to experience a rich and colorful online service content, not for users to use the service for economic gain. Therefore, the user promises not to use the "EasyLink" platform for profit-making purposes. Any use of "EasyLink" platform services for profit-making purposes will be regarded as seeking improper benefits, including but not limited to users:
3.6.1 Trading user accounts or service products on trading platforms not provided or recognized by "EasyLink" for profit;
3.6.2 Profiting by selling others' user accounts or service products through account theft, password fraud, and other means;
3.6.3 Any other profit-making activities not aimed at normal entertainment interaction needs.
3.7 In addition to the above clauses 3.1-3.6, "EasyLink" will periodically publish specific operational rules (such as the "EasyLink User Agreement", etc.) on the official "EasyLink" platform and client. The user agrees to comply with the above operational rules as well. If the user violates the relevant operational rules, the user agrees and accepts that "EasyLink" may take punitive measures based on the specific operational rules, including but not limited to suspending services, suspending accounts, etc.
3.8 If a user infringes upon the legitimate rights and interests of a third party while using "EasyLink" services, the user shall bear the corresponding responsibility, and "EasyLink" assumes no responsibility. If "EasyLink" is subject to infringement claims from a third party due to the user's infringing actions, the user shall bear all expenses paid by "EasyLink" in responding to such claims (including but not limited to lawyer fees, litigation costs, travel expenses, etc.) and losses. If "EasyLink" pays the infringement compensation first, it has the right to seek recovery from the user.
3.9 Users shall not reverse engineer, reverse assemble, or reverse compile this software; shall not use third-party plugins to interfere with, modify, or damage this software; shall not use possible bugs or rule loopholes in the software to seek improper benefits.
3.10 You fully understand and agree that you must be responsible for all actions under your registered account, including any content you publish, comments you make, likes you give, recommendations you make, and any consequences arising therefrom. You should exercise your own judgment regarding the content in this service and bear all risks associated with using the content, including risks arising from reliance on the correctness, completeness, or usefulness of the content. We cannot and will not be liable for any loss or damage arising from the aforementioned risks.
4. Disclaimer Statements4.1 The user acknowledges: When using "EasyLink" services, the user may suffer from infringement caused by "perpetrators" maliciously publishing or implementing content including but not limited to threatening, defamatory, offensive, or illegal content, or the user's legal rights (including but not limited to intellectual property rights, virtual assets, etc.) may be infringed upon by "perpetrators", whether anonymously or by impersonation. The user promises to unconditionally bear the above risks and waives any claims against "EasyLink". "EasyLink" makes no warranties regarding the services provided, whether express or implied, including all implied warranties and conditions of information authenticity, merchantability, fitness for a particular purpose, title, and non-infringement. It shall not be liable for any direct, indirect, incidental, special, or consequential damages arising from any improper or illegal use of the service by the user.
4.2 Users using "EasyLink" services must comply with relevant national laws and policies, safeguard national interests, protect national security, and abide by these terms. Users are fully responsible for all responsibilities arising from their illegal use or use that violates this agreement (including but not limited to speech publication, dissemination, etc.).
4.3 The "EasyLink" service, like most Internet products, is susceptible to various security issues, including but not limited to:
4.3.1 Users' detailed personal information being illegally obtained and used by criminals, causing real-life harassment;
4.3.2 Deception, password cracking;
4.3.3 Other downloaded and installed software containing viruses like "Trojan horses", threatening the security of information and data on personal computers, and subsequently threatening the use of this service. In case of the above situations, the user shall bear the responsibility themselves.
4.4 The user understands that the instability of internet technology, government policy controls, virus intrusions, hacker attacks, server system crashes, or other risks that cannot be solved by current technology may lead to interruption of "EasyLink" services or other losses within the account. If the aforementioned reasons cause any loss to the user, the user promises to bear such loss themselves and unconditionally waives any claims against "EasyLink" arising from the aforementioned reasons.
4.5 "EasyLink" does not guarantee the effect, promotion, or accuracy of information of advertisements or information published on the "EasyLink" platform. Users should carefully judge when contacting these advertisements or information, and the user promises: any loss suffered by the user due to using advertisements or information published on this website shall be resolved through negotiation between the user and the actual provider of the advertisement/information. The user unconditionally waives the right to pursue the aforementioned claims against "EasyLink".
4.6 The user agrees that "EasyLink" may send service information and commercial advertisements to devices or software used by the user to receive information, including but not limited to landline phones, mobile phones, email, QQ, Weibo, WeChat, etc.
4.7 For any disputes and/or losses encountered by the user due to the actions of other users while using "EasyLink" services, in principle, the user shall resolve them independently and bear corresponding responsibilities, and "EasyLink" is not involved.
4.8 Given the particularity of network services and technical services, the user agrees that "EasyLink" has the right to change, interrupt, or terminate part or all of the services (including paid services) at any time without prior notice. "EasyLink" does not guarantee that the services provided will be uninterrupted and makes no warranties regarding the timeliness, security, or accuracy of the services.
4.9 "EasyLink" shall not be liable for any interruption of "EasyLink" platform services within a reasonable time caused by the following circumstances;
(1) "EasyLink" needs to perform regular or irregular inspections or maintenance on the platform or related equipment providing network services. "EasyLink" reserves the right to suspend any part of the service for maintenance, upgrades, or other purposes without prior notice.
(2) Force majeure events such as typhoons, earthquakes, floods, lightning, or terrorist attacks;
(3) Failures in the user's computer software/hardware, communication lines, or power supply lines;
(4) Reasons such as viruses, trojans, malicious program attacks, network congestion, system instability, system or equipment failures, communication failures, power failures, bank issues, third-party service defects, or government actions.
Despite the foregoing, "EasyLink" will take reasonable actions to actively promote the restoration of normal services.
4.10 The technical services provided by "EasyLink" will enable users to access cloud computer resources provided by third parties. As a provider of cloud service technology, "EasyLink" is not the supplier or operator of the cloud computers and cannot control any content within the aforementioned cloud computers. You understand and agree that "EasyLink" is not responsible for whether such cloud computers are available for experience and use; "EasyLink" also does not guarantee or is responsible for any content, advertisements, products, or other materials or information existing in or originating from the cloud computers. "EasyLink" assumes no responsibility for any damage or loss incurred by users arising from the use of cloud computers or any content, goods, or services obtained via cloud computers.
4.11 "EasyLink" has the right to temporarily or permanently modify or terminate this service (or any part thereof) at any time, with or without notice, and "EasyLink" shall not be liable to users or any third party.
5. Intellectual Property Rights5.1 "EasyLink" owns complete and full intellectual property rights to the following content: elements such as text, images, videos, audio, software of "EasyLink", service marks, logos, and patents of "EasyLink".
5.2 Users may only use "EasyLink's" intellectual property within the scope authorized by this agreement and the corresponding licensing agreement ("Scope of Intellectual Property Use"). Unauthorized use beyond the "Scope of Intellectual Property Use" constitutes infringement of "EasyLink's" intellectual property rights. "EasyLink" has the right to take measures including but not limited to warnings, litigation, and arbitration to protect its legitimate rights and interests against such infringements.
5.3 For information originally created by users, such as text and images uploaded and published when using "EasyLink" services, the intellectual property rights of the aforementioned information belong to the user. However, the user agrees that their act of publishing and uploading on the "EasyLink" platform constitutes an authorization to the "EasyLink" service platform. The user confirms that the information they publish and upload is non-exclusive and constitutes a permanent authorization to "EasyLink", which can be sub-licensed. "EasyLink" may use the aforementioned information for free on service platforms under "EasyLink", may re-edit it for free use, or may authorize partners to use it.
5.4 If information within the "EasyLink" software or information uploaded, stored, or disseminated by other users infringes upon the intellectual property rights of a third party, the infringed party can report the complaint through the complaint channel provided by "EasyLink". "EasyLink" has the right to take reasonable measures to handle the aforementioned infringement.
6. Privacy Protection6.1 Users are advised not to disclose important information and materials such as their various property accounts, bank cards, credit cards, third-party payment accounts, and corresponding passwords while using "EasyLink" services. Any losses arising therefrom shall be borne by the user.
6.2 When using "EasyLink" services, users must not publish or upload information they consider private to "EasyLink", nor disseminate such information to others through "EasyLink" services. If privacy leakage is caused by the user's own actions, the user shall bear the responsibility.
6.3 "EasyLink" fully understands the importance of personal information to users and will do its utmost to protect the security of users' personal information. For specific privacy policies of the "EasyLink" platform, please refer to the "Privacy Agreement" on the "EasyLink" platform.
7. Other Clauses7.1 The titles of all clauses in this agreement are for convenience only, have no actual meaning, and cannot be used as a basis for interpreting the meaning of this agreement and related clauses.
7.2 If any clause in this agreement is deemed wholly or partially invalid or unenforceable for any reason, the other clauses of this agreement shall remain in full force and effect. "EasyLink's" failure to exercise, delay in exercising, or insufficient exercise of any right under this agreement or under the law shall not be deemed a waiver of such right, nor shall it affect "EasyLink's" exercise of such right in the future.
7.3 After the user accepts this agreement, this text may be modified due to changes in national policies, products, or the environment in which this agreement is performed. The modified agreement will be published on all "EasyLink" products (including but not limited to APP, website). The publication of the modified agreement is deemed as "EasyLink" notifying the user of the agreement modifications. If the user disagrees with the modified agreement, please immediately stop accessing and using the "EasyLink" platform services. If the user continues to access or use them, it is deemed as acceptance of the modified agreement.
7.4 If "EasyLink" currently has separate agreements, rules, or guidelines for a specific service provided to users, users must comply with those separate agreements, rules, and guidelines. Users' acceptance of all other services requires compliance with this agreement.
7.5 This agreement may exist in multiple language versions, including Chinese and English. If there is a conflict between the Chinese version and versions in other languages, the Chinese version shall prevail.
7.6 Your use of this software constitutes your acceptance of this agreement. We reserve the right to modify the terms of this agreement when necessary. You can review the relevant terms in the latest version of this software. If you continue to use this software after the terms of this agreement are modified, you will be deemed to have accepted the modified agreement. If you do not accept the modified agreement, you should stop using this software.
7.7 The establishment, entry into force, performance, interpretation, and dispute resolution of this agreement shall be governed by the laws of the mainland region of the People's Republic of China (excluding conflict of laws rules).
